New Laptop Search Directives Issued

Two new directives were issued on Aug. 27 clarifying the operating procedures for U.S. Customs and Border Protection (CBP) and Immigration and Customs Enforcement (ICE) to search laptops and other electronic media at U.S. borders including airports.   

 
The new directives are supposed to provide for more transparency, accountability and oversight of electronic media searches. Officers must obtain a supervisor’s approval to detain a device or make copies of information on the device after the traveler has departed the port of entry and must provide contact information to the traveler. The directives state that CBP should ordinarily complete its search of an electronic device within five days and ICE within 30 days.
 
In the nearly 11 months of the current federal fiscal year, CBP has searched 1,000 laptops of the 221 million passengers at U.S. ports of entry. And, only 46 searches were considered in-depth.
 
Nothing in these new directives, however, changes the U.S. Government’s position that CBP and ICE may search electronic media without having any reasonable suspicion regarding a particular individual. Thus electronic media are treated no differently than baggage. The government’s position was upheld in 2008 court ruling that “reasonable suspicion is not needed to for customs officials to search a laptop or other personal electronic storage devices at the border” by virtue of the border search doctrine which recognizes a country’s inherent sovereign right to protect its territory.

Education Update:

NextGen: It Begins and Ends at Airports

Four speakers are now committed to address the topic, NextGen: It Begins and Ends at Airports, in an Oct. 12 concurrent session. Much of the discussion this year has centered on what can be done now, and in the very near future, to realize NextGen benefits. In this session, the speakers will talk about critical efforts that have taken place over the summer, how airports fit into NextGen plans, and what your airport can be doing now to be ready. Speakers: Dr. Agam N. Sinha, senior vice president, The MITRE Corp.; Steve Vail, senior manager, Air Traffic Operations, FedEx; James M. Crites, executive vice president operations, Dallas/Fort Worth International Airport; and John Crichton, CEO, NAV Canada. Charles "Skip" T. Miller, executive director of airports, Louisville Regional Airport Authority, will be the moderator.

Reputation Management: Maintaining Your Airport Brand in Challenging Times

The second concurrent on Oct. 12 will feature two speakers discussing brand management. To remain strong in these rapidly changing times for the industry, an airport must develop a strong brand that is recognized by travelers, airlines, and other stakeholders alike. In this session, branding experts will discuss successful strategies for developing and/or enhancing a powerfully positive brand for your airport. Speakers: Neal M. Burns, director, Center for Brand Research, Department of            Advertising, University of Texas, and Christopher Baum, senior vice president, sales and marketing, Metro Detroit Convention Visitors Bureau. Tom Ruth, CEO, Halifax International Airport Authority, will be the moderator.

Deborah Ale Flint
Deborah Ale Flint was appointed to Acting Aviation Director at Oakland International Airport by Port of Oakland Executive Director Omar R. Benjamin. The Port's former Aviation Director, Steve Grossman, accepted a new position as the Executive Director of the Jacksonville Airport Authority in Florida. A 12-year airport employee, Flint has been serving as the assistant aviation director for the last two years.

 

Katherine Green
Katherine (Kitty) Green has been appointed to the Lee County Port Authority Airports Special Management Committee by Lee County Port Commissioner Brian Bigelow. The committee serves as an advisory board to the Lee County Board of Port Commissioners, reviewing policy, administrative and management matters for Southwest Florida International Airport and Page Field General Aviation Airport. Green has held executive leadership positions at The Bonita Bay Group and WCI Communities.

 

Roderick D. Hall
Roderick D. Hall has been appointed as the new assistant administrator for government affairs at the Federal Aviation Administration. As the agency’s chief congressional liaison, Hall will serve as the advisor on matters concerning Congress and other government organizations. Hall spent the last nine years as a congressional staffer, most recently as deputy chief of staff to U.S. Rep. Eddie Bernice Johnson, D-Texas, a senior member of the House Transportation and Infrastructure Committee.

Canadian Air Traffic Down in July

Aircraft take-offs and landings at Canadian airports with NAV Canada air traffic control towers and flight service stations decreased 5.4 percent in July compared with July 2008. These 93 airports reported 597,360 movements in July compared with 631,467 movements at 95 airports in July 2008.

 

The July 2009 issue of Aircraft Movement Statistics: NAV Canada Towers and Flight Service Stations is now available. The report is a joint publication of Statistics Canada and Transport Canada.
