Senate Committee Pushes FAA Bill Forward

On Tuesday, the Senate Committee on Commerce, Science, and Transportation voted to discharge the FAA Air Transportation Modernization and Safety Improvement Act, S. 1451 from Committee.

ACI-NA President Greg Principato noted: "The Senate Commerce Committee's actions this afternoon move us another step closer to having an FAA Reauthorization bill completed this year. This bipartisan bill helps fast track NextGen implementation and final passage of a multi-year FAA Reauthorization bill would provide airports, along with the entire aviation industry, the stability it needs to plan for the future. NextGen begins and ends at the airport, and we need to continue moving forward with our infrastructure improvements in order to ensure our airports are ready for the increased traffic that will follow the implementation of NextGen.

"We hope the full Senate will consider the FAA Air Transportation Modernization and Safety Improvement Act as soon as practical, as it is imperative that Congress complete its work on this bill this year."

Major provisions affecting airports include:

  • Changes to help streamline the Passenger Facility Charge (PFC) consultation process with the airlines and the public notice and comment period for the local community.
  • A pilot program for up to six airports to be exempt from any PFC rate ceiling, but requires those airports to collect the PFC directly from the passengers as opposed to having the air carriers collect it.
  • A GAO study of the alternative means of collecting a PFC that would permit the charges to be collected without being included in the ticket price.
  • An increase in the authorization levels for Airport Improvement Program: 2010 - $4 billion; 2011 - $4.1 billion.
  • A special provision to allow those airports whose enplanement numbers have dropped below 10,000 in either 2008 or 2009 to continue to be eligible for AIP (AIP) grant money at their 2007 funding level.
  • An increase in the authorization of the Essential Air Service program to $175 million.
  • Reauthorizes the Small Community Air Service Development program.
  • Creates an environmental mitigation demonstration program which would allow up to six projects that will measurably reduce or mitigate aviation impacts on noise, air quality or water quality in the vicinity of the airport to be AIP-eligible. This program is very similar to the program created in H.R. 915.
  • Allows the purchase of glycol recovery vehicles to be AIP-eligible.
  • An airport recycling program which would require airports to incorporate a recycling plan into their airport master plan. This section is similar to the airport recycling program in H.R. 915.
  • S. 1451 does not include any language addressing ARFF standards.

Before S. 1451 can be considered by the full Senate, the tax provisions, including the jet fuel tax, must be considered by the Finance Committee. It is unclear when the bill will be considered by the full Senate.

ACI-NA Urges Administration to Call for PFC Increase
ACI-NA Meets with Senate Democratic Steering Committee

Last week, ACI-NA President Greg Principato, Immediate Past Board Chairman Randy Walker and Chicago Aviation Commissioner Rosemarie Andolino represented the aviation industry at the Senate Democratic Steering Committee's meeting on transportation infrastructure. They were joined by John Duval, newly elected board chairman of Association of American Airport Executives (AAAE).

Majority Leader Harry Reid, of Nevada, opened the meeting, which was run by Michigan Sen. Debbie Stabenow, chair of the Steering Committee. They were joined by 10 senators. In opening remarks, Pennsylvania Gov. Ed Rendell spoke of the importance of user fees, such as toll roads, in funding transportation infrastructure. Principato pointed out that aviation has the single most efficient and effective user fee in transportation - the Passenger Facility Charge (PFC). He explained that the PFC limit has not been raised in nearly 10 years and that an increase is sorely needed.

Principato also thanked the senators for the passage of the American Recovery and Reinvestment Act, and discussed the success of the $1.1 billion provided for airports in the bill, using the $15 million project at the Detroit Metropolitan Wayne County Airport as an example, as well as the success of the alternative minimum tax (AMT) waiver provision.

Principato applauded the introduction of the Senate Commerce Committee's Federal Aviation Administration (FAA) reauthorization bill and stressed the importance of completing work on the bill this year in order to provide the planning and funding stability necessary for the industry to move forward.

Walker highlighted the importance of the AMT waiver in the stimulus. McCarran International Airport just finished the placement of $400 million of bonds using the AMT holiday. This funding was essential to the continuation of the current $2.5 billion Terminal 3 construction project, he said. Without the funding raised by the bond sale, the project would have been halted eliminating 1,600 jobs. Walker made a strong case for making the AMT waiver permanent.

Andolino outlined O'Hare's modernization program as well as reiterating Principato's comments on the need for an FAA reauthorization bill this year that includes a PFC increase. She noted that while airline traffic is down now, it will come back and when it does, airports need to be ready; that we cannot wait until traffic returns to record levels to begin investing in infrastructure.

These points were amplified by Duval who reiterated the need for a PFC increase, a robust Airport Improvement Program and a permanent waiver of the AMT penalty.

2009 Small Community Air Service Development Program Opens

The Department of Transportation (DOT) on July 17 issued its most recent request for communities to see federal grants under the Small Community Air Service Development Program. DOT has received up to $8 million to be distributed to no more than 40 projects.

While the project submission deadline is Aug. 28, communities are required to pre-register with www.grants.gov if they have never done so. DOT officials note that it may take three weeks to complete this pre-application process. DOT anticipates completing the review of the proposals in December.

Since 2002, the program has provided financial assistance to small communities to help them enhance their air service. The size of the grants has ranged from $20,000 to $1.6 million. ACI-NA has continued to support the inclusion of the program in the annual DOT appropriation.

Austin's Hotel Rooms Going Fast

Hotel rooms are filling up fast for the 2009 ACI-NA 18th Annual Conference and Exhibition in Austin. Rooms are sold out at the Hilton Austin, the Courtyard Austin and the Residence Inn Austin. However, there are still rooms available at the Radisson Austin.

The Conference and Exhibition will be held on Oct. 11-14 at the Austin Convention Center. On Oct. 10 and 11, ACI-NA will also offer participants the opportunity to attend five pre-conference seminars on various topics of interest at the Hilton Austin.

ACI Training Opportunities:

AELP Adds Duke Leadership Expert to Program
ACI has added Dr. Gregory Dale, Director of Mental Training and Leadership, Department of Duke Athletics, to its resource team for the autumn session of the Airport Executive Leadership Program.

The ACI/Concordia University program runs from Sept. 14 to Nov. 13, with two online sessions bracketing the classroom session at Jacksonville Airport Authority on Oct. 3 to 9.

Dale has recently completed extensive leadership counseling with the World Bank, Habitat for Humanity and an NFL football team, which recently won the Super Bowl. According to Dr. Pierre Coutu, the AELP Course Leader, "the addition of Dr. Dale, along with the delivery team from Concordia, which includes professors from Greece and Germany, promises to make this autumn's AELP promises an exceptional international learning experience."

The AELP offers practical strategies to handle senior-level executive responsibilities in an effective manner and provides a forum for future networking among alumni. The online sessions of this course, which has been run successfully four times counts 72 graduates from some 25 countries.

A number of slots are still available in the course, which is limited to 25 participants. The application deadline is Aug. 10.

Concession Course Now Available Online
The Online Learning Centre of ACI's Global Training Hub is now offering a Certificate in Concession Management course designed for staff engaged in managing concessions such as retail, food/beverage, duty free, services, parking and ground transportation and rental cars. Several ACI-NA members, including Atlanta and San Diego, have already used the course.

The next Air Transport System course -- the mandatory first-step in the ACI/ICAO Airport Management Professional Accreditation Program (AMPAP -- will be offered in Houston the week of Dec. 7-11. This class must be completed before students can progress to the rest of the six-course curriculum.

Water Quality Working Group

The Water Quality Working Group of ACI-NA's Environmental Affairs Committee provides technical input and oversight to the many water quality-related issues airports face. One of the current priorities is the U.S. Environmental Protection Agency's (EPA) development of effluent limitation guidelines for airport deicing activities. In cooperation with the Air Transport Association (ATA), the working group has provided detailed technical input to EPA on their initial concepts for a regulatory approach and is now preparing for the issuance of a proposed rule next month. The working group also provided input to ACI-NA in programming the ACI-NA/ATA/RAA Deicing Management Conference that was held in Cincinnati earlier this month.

Other working group activities include analyzing the impact of revisions to EPA's Spill Prevention, Control, and Countermeasure (SPCC) rule and helping to ensure airports have developed adequate SPCC plans; informing airports of the effects of the multi-sector general permit for industrial activities; and working with EPA and the Food and Drug Administration on requirements for airport watering points supplying potable water to aircraft. Participation on the working group is open to any airport or associate member interested in water quality issues.

2 NTSB Members Resigning
Two members of the five-member National Transportation Safety Board (NTSB) have announced their plans to resign. Acting Chairman Mark V. Rosenker will resign once a new chairman and an additional board is confirmed to ensure a quorum remains at the board. Board Member Kathryn (Kitty) O'Leary Higgins will resign from the board effective Aug. 3. Higgins plans to join a firm in the private sector while Rosenker did not announce any plans. Rosenker joined the board in 2003 and Higgins joined the board in 2006. The board has one open seat awaiting the confirmation of Christopher Hart, a former NTSB member, to fill a new term on the board.

Lauren Foster
Lauren Foster, Assistant Controller with Wayne County Airport Authority, is one of 28 certified public accountants under age 35 from around the United States selected by the American Institute of Certified Public Accountants for its first annual Leadership Academy. Foster joined her professional colleagues July 7-9 in Chicago to begin developing her potential as a future leader of the CPA profession. Prior to joining the airport authority in 2005, Foster was part of KPMG's Assurance Division, where she spent four years performing audits.

Bob Hope Airport

Bob Hope Airport (BUR) in Burbank, Calif., serves 5 million annual passengers and has long been known for its convenience, proximity to downtown Los Angeles and the San Fernando Valley, and for great nonstop service along the West Coast. Opened in 1930, the airport now has 14 aircraft parking positions and offers two intersecting runways 6,886-feet and 5,801-feet in length. Alaska, American, Delta Connection, JetBlue, Southwest, United Express and US Airways serve the airport with nonstop flights to Oakland, San Francisco, San Jose, Sacramento, Portland, Seattle, Las Vegas, Phoenix, Salt Lake City, Denver, Dallas-Ft. Worth and New York.

With the completion this year of a new baggage inspection and makeup building, Bob Hope Airport is one of only 14 in the nation with 100 percent inline explosives detection system baggage inspection service.

After nine years of effort, Bob Hope Airport became the first airport since the passage of the Airport Noise and Capacity Act of 1990 to have its Part 161 Study and application for a mandatory night time access restriction deemed complete by the Federal Aviation Administration.

The airport is now in the early stages of developing a new $100 million regional intermodal transit center in which public bus, rail transit and a consolidated rental car facility will converge, located immediately adjacent to the terminal.

The airport is owned and operated by the tri-city Burbank-Glendale-Pasadena Airport Authority.

New Research Posted

Aviation Weather: The National Weather Service and the Federal Aviation Administration and FAA are considering plans to restructure the way aviation weather services are provided at en route centers, but it is not yet clear whether and how these changes will be implemented. In its draft report, GAO is recommending that Commerce and Transportation departments document baseline performance for several measures, and take steps to address underlying challenges affecting the agencies' efforts.

U.S. Passenger Traffic Drops 26% in June

The Air Transport Association (ATA) on July 20 reported that passenger revenue fell 26 percent in June 2009 versus the same month in 2008 - the eighth consecutive month in which passenger revenue has fallen from the prior year.

The number of passengers traveling on U.S. airlines in June fell 6.5 percent while the average price to fly one mile fell 20.7 percent, a sharp decline surpassing even those witnessed during the 2001 recession and post-9/11 terrorist attacks. Revenue declines extended beyond the mainland United States to the trans-Atlantic, trans-Pacific and Latin markets.
