Trial Date Set for the Antitrust Lawsuit Challenging the US Airways/American Merger

For those who were unable to participate in the ACI-NA webinar held on August 29, 2013, concerning the antitrust lawsuit challenging the US Airways/American merger, the following is a weblink to the powerpoint and audio of the webinar.

On Friday, August 30, 2013, a Scheduling Conference was held in the case pending in the federal court in the District of Columbia.  Judge Colleen Kollar-Kotelly, the judge assigned to the case, issued the attached Scheduling Order today.  The most significant date is that of the trial, which has been scheduled to begin on Monday, November 25, 2013.   Counsel for the airlines had requested a commencement date of November 12, 2013, and counsel for the government had requested a trial date of March 3, 2014.The trial is expected to last 10 to 12 days.  

Other important dates are:

  • September 4, 2013, the date by which the parties must file a joint proposed order concerning referral of discovery disputes to a special master. 
  • September 30, 2013, the date by which the parties must file a joint status report of outstanding issues the Court needs to address.
  • October 1, 2013, the date of the next status hearing in the case, when the parties will discuss trial procedures and pre- and post-trial briefing.
